Negligent but not Liable – Clinical Negligence Case

The fundamental features of a Clinical Negligence case requires a demonstration that negligence has occurred and harm has been caused. In a recent ruling Palmer v Portsmouth Hospitals NHS Trust [2017] EWHC 2460 (QB) (15 September 2017) the judge was satisfied that there was a breach of duty by the Defendant, However he was not able to establish causation. Consequently the claim was dismissed.
